DISTANCE SALES AGREEMENT

Parties:

This agreement is entered into between the Seller and the Buyer as specified below:

This agreement is concluded between ESPEKI (ESRA PERUZE KIZILTUĞ TİNER), address: Yakacık Yeni Mahalle Samandıra Caddesi No .49/A Kartal – İstanbul, email: [email protected], phone: +90532 574 44 02, and the Buyer who makes purchases electronically through the website www.espeki.com.

Subject:

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Distance Sales Regulations regarding the sale and delivery of the product/products specified in the contract, including the type, quantity, and sale price of the product/products ordered electronically by the Buyer from the Seller’s website www.espeki.com.

Information on the Subject Product/Products:

General Provisions:

4.1. The Buyer confirms electronically that they have read and understood the basic characteristics of the product/products subject to the contract, the sale price, payment method, and pre-information about delivery on the www.espeki.com website.

4.2. The Seller is responsible for delivering the products to the consumer complete and in accordance with the specified specifications after the delivery of the products subject to the contract to the consumer.

4.3. The products subject to the order are delivered to the delivery address specified by the Buyer in the contract within the specified period.

4.4. The Buyer has the right to withdraw from the contract within 7 (seven) days from the date of receipt of the product/products without assuming any legal or penal responsibility. However, the right of withdrawal cannot be exercised for swimsuits, used, washed, perfume-scented, or items with removed labels due to hygiene conditions.

Cancellation and Return Policy:

5.1. Cancellation Conditions: The Buyer can cancel their order before it enters the shipping process. Orders are usually shipped within 24 hours. The cancellation request must be made through customer service during this period. No additional fees are charged for cancellation transactions.

5.2. Return Conditions: Returns of products are not accepted.

5.3. Return and Exchange Process: After receiving the product, the Buyer can request a return or exchange within 7 (seven) days by contacting customer service under the conditions specified above. The request will be evaluated by the Seller and processed if deemed appropriate.

The Buyer has the right to withdraw from the contract without stating any reason within 7 (seven) days from the date of receipt of the product/products. However, the right of withdrawal cannot be exercised for swimsuits, used, washed, perfume-scented, or items with removed labels. The withdrawal period starts from the date the product is received.

Product Return and Return Expenses

Since the return of the product/products is not accepted when the right of withdrawal is exercised, the return expenses are borne by the Buyer.

Payment Terms:

7.1. Payment Methods: The Buyer can only make payments with a credit card for purchases made on the www.espeki.com website.

7.2. Payment Security: The Seller works with reliable intermediary organizations such as PAYTR to ensure the security of payment transactions. PAYTR processes payments using secure payment pages and encryption techniques.

7.3. Payment Confirmation: After the payment is successfully completed, an email containing payment confirmation and order details is sent to the Buyer. Payment must be completed and confirmed before the order is processed.

Delivery Information and Shipping Fee

8.1. Your orders are shipped with DHL Courier Company. Deliveries to European countries are aimed to be made within 2 days, and to America and Asia continents within 3 days.

8.2. The customs rules of the country of delivery apply. Customs processing fees and taxes are the responsibility of the recipient according to the relevant customs rules of the country of delivery.

8.3. The shipping fee is paid by the Buyer during the payment process. The shipping fee may vary depending on the delivery address and country. The shipping fee is specified on the payment page after the order is completed.

8.4. By accepting the specified shipping fees on www.espeki.com website, the Buyer completes the order process.

This agreement is accepted for each order made by the Buyer on the www.espeki.com website and becomes effective on the date it is electronically approved by the parties.

Any written communication between the parties is conducted via the addresses and contact information specified above.

This agreement is accepted to be valid for each order made by the Buyer on the www.espeki.com website.
